In Germany I cannot not get a court order without a opponent. I need the registration data, espacially the IP-Adress, to let the Authorities determine the person. But this is only possible within 5-7 days and the Authorities will not do somthing if I tell them they should ask someone in the USA. WordPress.com doesn't give me the data, so there will be no court-order. Also I will not get a court-order if the data comes to late or if the Authorities don't want to determine the Person.

So, I don't have a good chance to get a court-order! And so the illegal content will not be deleted!

I think in this case writing and filing are two separate things. VERY separate.

If you have documentation of that (court filings, police reports, etc.) , forward it to the Abuse Team.

A court order is not a court case. It costs only to file the paperwork.

What do you think? This mentally impaired person is stalking me for 2 years now, up to the death threat, I have written 15 lawsuits against him. Authorities have not done anything at all! If they had, my lawyer would be able to do something. But there is really NOTHING!

If you don't have proof, you're not going to get a court order anywhere.

If you think the content actually violates German law, contact your local authorities and let them deal with it.

You do not need the IP address of the blog to get a court order.

In my opinion, what you're doing is advertising for them and getting them even more hits than they might normally. You're helping them more than yourself.

In your own words:

wordpress.com answered that I had to send a court-order, then (and not before) they will delete the posting. So I have to use every chance to get it deleted!

So there really isn't anything anyone else can do. If you can convince a Judge to issue an order, WP will act accordingly.

It's not a expression of an opinion, it's a intentional false statements of fact are to defame other!

Of course, he expects that the posts will not be deleted because the operators do not speak the German language. Of course, he has decided to take a Hoster abroad

We don't know that it's 'illegal'.

Someone expressing their opinion is not 'illegal'. There are millions of posts all over the web expressing opinions against major companies trying to stop people from patronizing them, but those opinions are not 'illegal'.

I personally try to talk people out of going to Walmart, but it is not 'illegal' for me to do so.

How do we even know that it isn't the truth that you're trying to suppress?

I can't read German and don't feel like bothering with a translator, but maybe the person is right? Whoever it is, is certainly entitled to express their opinion.

I understand your frustration but we are just ordinary bloggers here helping out and even if we flagged this for staff they would direct you to the 'abuse' team section as it's those who can help you, and staff won't discuss such things in an open forum anyway. By posting here you are also giving that blog more viewers as this thread will be indexed by Google (almost immediately) and people will click the link to see what it's all about!!
