You can, but if you do, you'll still need the Custom Design upgrade and be sure to hire a designer who is used to working with WordPress.COM instead of WordPress.ORG. Lots of people lose hundreds or thousands of dollars hiring designers who are only used to WP.org and can't work with WP.com.
