    From: http://en.support.wordpress.com/themes/premium-themes/

Note: Premium Themes are customized for WordPress.com usage only, and cannot be transferred to self-hosted WordPress.org sites.

You can’t transfer themes from one form of WP to another. You can, however, look and see if Delicious magazine is available for WP.org. Themes are not exportable.

We are really not equipped to answer questions relating to Wp.org, so look at their own forums for answers.

On the export, export by date range on the posts and cut things about in half. Then export the pages separately as well.

Is there a reason that this is not allowed? What happens if you have this theme and transfer it? Does it just refer back to a standard theme?

You can’t directly transfer a premium .com theme to .org because, even though they may be functionally similar, they’re installed and supported entirely separately. If you want to use the same premium theme on .org, and you’ve had it too long to be eligible for a refund from wordpress.com, you could always ask the theme company if there’s any chance of a discount on the .org version, since you already paid for the .com version.

(I don’t rate your chances, since I’m not sure they would actually have a record of the purchase on their side, but it wouldn’t hurt to try.)
